Ⅲ. Handling Conditions
It shall satisfy one of the following conditions when applying to Hunan Province Administration for Industry & Commerce for approval registration of the enterprise name with “Hunan”:
(1) The registered capital of company business entity and non-company business entity shall be 2 million Yuan or more.
(2) The amount of contribution of individual proprietorship enterprise or partnership enterprise shall be 2 million Yuan or more;
(3) Registered in Hunan Province Administration for Industry & Commerce;
(4) If it does not comply with the above (1) and (2) conditions but complies with laws, administrative regulations and the State Council decisions and regulations, it can register in Hunan Province Administration for Industry & Commerce that can authorize or entrust the local industry and commerce administration bureau accordance with the relevant provisions.
Ⅳ. Application Methods
(1) Prior approval of enterprise name
Online application
1. The applicant applies for enterprise name online. Login the online registration hall of Hunan Province Red Shield Information Network (hppt://zcj.hnaic.gov.cn). Fill in "Application Form of Enterprise name Prior Approval" . Hunan Province Administration for Industry & Commerce examines the enterprise name. If the name isn’t approved, it will be returned to the applicant for revision and reapplication or be rejected. If the name is approved, Hunan Province Administration for Industry & Commerce will issue the Approval Notice (without official seal) to the applicant through the network.
2. If the name is approved, the applicant can download and print the Approval Notice. And the designated representative or principal can apply for printing the Notification of Enterprise Name Prior Approval to the registration authority with the Approval Notice. After getting the online approval of the enterprise name with province name registered in city- and country-level industrial and commercial bureau, the applicant can submit the Approval Notice to city and country-level industrial and commercial bureau and then get the Notification.
3. The registration authority of the companies which will be set up shall confirm the information of the Approval Notice. If it is correct, print the Notification of Enterprise Name Prior Approval, stamp with the special registration seal and issue it to the applicant.
Onsite application
For the enterprise name with “Hunan”, the applicant shall go to Hunan Province Administration for Industry & Commerce to handle with the Application Form of Enterprise Name Prior Approval (including the letter of authorization and ID copies of the designated representative or common entrusted agent)
(2) Adjustment of approved name
The applicant can apply for adjusting some items that have got approval (adjusting the address, registered capital or extending the retention period, etc.) for the enterprise name that has got prior approval (the enterprise name that gets approval but haven’t handled establishment registration within the period of validity).
Online application
Refer to the procedures of enterprise name online prior approval for adjusting the name that has got approval.
Onsite application
For adjusting the enterprise name with “Hunan”, the applicant shall go to Hunan Province Administration for Industry & Commerce for onsite application with the Application Form of Enterprise name Prior Approval (including the letter of authorization and ID copies of the designated representative or common entrusted agent) and the Notification of Enterprise name Prior Approval.
Notes:
1. The information of“Enterprise name” and “ Investor” in the Notification of Enterprise name Prior Approval shouldn’t be changed. If the name or license number of the investor is error, submit the copies of investor’s ID, business license or other valid certificates and the Notification of Enterprise name Prior Approval that has been issued, and correct errors at Hunan Province Administration for Industry & Commerce according to the relevant provisions of the name registration.
2. The applicant only can apply for (6 months) extension of the validity period of Notification of Enterprise name Prior Approval with legitimate reasons once. The extension shouldn’t be applied for the second time.
3. The extension of Notification of Enterprise Name Prior Approval shall be applied for one month before the expiry of the validity period. Return the Notification of Enterprise Name Prior Approval when applying for extension.
(Ⅲ) Approval for changing enterprise name.
The company that has registered in Hunan Province Administration for Industry & Commerce can directly change enterprise name at Hunan Province Administration for Industry & Commerce.
The company that has registered in city and country-level industrial and commercial bureau can change enterprise name by online application or onsite application.
Online application method
1. The company applies to the enterprise registration authority through the website.
2. The registration authority examines the new enterprise name. After approving the new name, it reports the new name to the Hunan Province Administration for Industry & Commerce by the commerce and industry department intranet.
3. After approving the name, Hunan Province Administration for Industry & Commerce will give feedback to the enterprise registration authority and the company. The company can directly apply for changing enterprise name to the registration authority. If the company needs, it can download and print the Approval Notice and other documents, submit the documents to the registration authority to get the Notification of Enterprise Name Prior Approval and apply for changing name within the validity period of the Notification.
Onsite application method
1. The company applies to the enterprise registration authority directly.
2. The registration authority examines the new enterprise name. After approving the new name, it shall issue the Notice of Acceptance with the enterprise registration authority seal to the company and report the opinion of primary examinations to Hunan Province Administration for Industry & Commerce by the commerce and industry department intranet.
3. After approving the name, the Hunan Province Administration for Industry & Commerce will give feedback to the enterprise registration authority. The company can get the Notification of Enterprise name Prior Approval from the registration authority with Approval Notice and apply for changing name within the validity period of the Notification.

Ⅵ. Handling deadline:
If the application submitted by the applicant or the entrusted agent in the registration hall of Hunan Province Administration for Industry & Commerce is accepted to be handled, the approval will be issued on the spot. If the application document and materials need to be verified, the decision will be given within 15 days since the handling date. If the application needs to be submitted by mail, the decision will be given within 15 days since the handling date.

Ⅷ. Handling Process
(1) Application
The applicant applies to the Hunan Province Administration for Industry & Commerce.
Examination and acceptance of handling
After receiving the application, Hunan Province Administration for Industry & Commerce will examine if the application materials are complete and conform to the legal form. The application materials are complete, that is, the applicant should submit all the materials that are required by the State Administration for Industry & Commerce according to the law, administrative laws and regulations of enterprise registration.
The application materials conform to the legal form, that is, the application materials conform to legal limits of time, the items meet the legal requirement and the document formats conform to the
specification.
After examining the registration application of the applicant, the Hunan Province Administration for Industry & Commerce will make the decision on whether to give acceptance of handling according to the following cases:
1. The acceptance of handling will be given if the application documents and materials are complete and conform to the legal form or the applicant supplements all the application documents and materials according to the requirements of Hunan Province Administration for Industry & Commerce.
2. If the application documents and materials are complete and conform to the legal form, but the Hunan Province Administration for Industry & Commerce considers that these documents and materials need to be verified, the acceptance of handling will be given and the items, reason and time will be told to the applicant in written form.
3. The acceptance of handling will not be given if the application documents and materials are not complete and don’t conform to the legal form
4. If it doesn’t belong to the category of enterprise registration or the registration jurisdiction of Hunan Province Administration for Industry & Commerce, the acceptance of handling will not be given and the applicant will be told to apply to the relevant administrative body.
(3) Decision
Hunan Province Administration for Industry & Commerce will decide whether to accept to handle the registration application within the prescribed time limit:
1. If the application which the applicant that submits at the Hunan Province Administration for Industry & Commerce is accepted to be handled, it will get the registration approval on the spot.
2. If it doesn’t conform to the legal condition, it will get the disapproval of registration.
If the Hunan Province Administration for Industry & Commerce needs verify the application documents and materials, it can decide whether accept the prior approval according to the verification condition.
Except for the registration approval on the spot, if the application is accepted to be handled by Hunan Province Administration for Industry & Commerce , Handling Notification shall be issued. If the application isn’t accepted, Disapproval Handling Notification shall be issued and the reason of disapproval shall be indicated.
(4) Notification of completion
The Hunan Province Administration for Industry & Commerce will issue the Notification of Enterprise name Prior Approval for the application which gets the acceptance of name prior approval and issue the Notice of Dismissal of Enterprise name for the application which doesn’t get the acceptance of name prior approval, indicate the disapproval reason and notify the applicant that it has the right to apply for administrative review or bring an administrative suit according to the law.
Ⅸ. Working Time
From Monday to Friday (except legal holidays) 8:00-12:00 A.M., 14:30- 17:30 P.M. (15:00-18:00 P.M. in summer). Study on the afternoon of Tuesday and Friday, arrange persons on duty.
